Child support may be just one of the issues in second marriages

When considering marriage after divorce, each partner will likely be influenced by his or her experiences during previous marriages and divorces. If previous divorces were contentious and expensive, with child support, custody and other issues, individuals would probably consider another marriage carefully before taking the step. Consulting with an experienced Alaska divorce attorney may eliminate some of the pitfalls associated with second or third marriages.

Although the circumstances and concerns of each person will be different, some common issues may arise. Possessions may overlap, and decisions will have to be made about which residence to keep. Should assets and finances be kept separate? This may be a good idea, but without a prenuptial agreement to specify separate property, keeping assets in the owners' names may not provide enough protection.

Children may be involved on both sides of the relationship, and with that, there may be spousal support and child support to be addressed. Also, any assets meant to go to children from previous marriages must be protected, and the best way to do this may be with a prenuptial agreement. Open and honest discussions typically bring about the best results when addressing assets, debts, retirement plans, social security and many other matters.

Fortunately, apart from matters pertaining to children such as child support, almost any other issue may be addressed in a prenuptial agreement. Each party must be represented by an attorney, and with their guidance, a couple can draft agreements that will protect the rights of both spouses during the marriage and in the event of a divorce. Retaining the services of an Alaska divorce attorney who focuses on protecting the interests and rights of those who were disillusioned by previous marriages may be beneficial.
